Terms of Service
The terms that apply to your use of PinglyMCP and its developer services.
Last updated:
1. Your agreement with us
PinglyMCP is operated by Ascenso Labs LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the PinglyMCP website, dashboard, REST API, Model Context Protocol (MCP) server, and related tools and services (together, the "Service").
By selecting a sign-in option accompanied by a notice of these Terms, or by accessing or using the Service after being presented with these Terms, you agree to them. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter into this agreement. If you use the Service for an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
Our Privacy Policy explains how we handle personal information. Acknowledging that policy does not constitute consent to optional marketing or to processing that requires separate consent.
2. Accounts, keys, and connected clients
Provide accurate account information and keep your sign-in credentials, API keys, and authorized clients secure. You are responsible for activity you authorize through your account, including requests made by agents, applications, or people to whom you give access. Grant only the permissions a client needs and revoke access you no longer trust.
Notify us promptly at support@pinglymcp.com if you suspect unauthorized use. Do not share credentials publicly, sell access to your account, or impersonate another person or organization.
3. Responsible use
You may use the Service only for lawful purposes and with the rights, permissions, and consents required for your requests. Public availability of a website or contact address does not by itself grant permission for every use. Respect applicable laws, third-party rights, website restrictions, and recipient preferences.
- Do not send spam, deceptive messages, phishing, harassment, or unlawful or unsolicited bulk communications.
- Do not use the Service to gain unauthorized access, exploit vulnerabilities, distribute malware, disrupt systems, or collect information unlawfully.
- Do not bypass rate limits, credit limits, access controls, safety checks, or restrictions on target websites or networks.
- Do not submit content that infringes intellectual property or privacy rights, or misrepresent your identity, authority, or purpose.
- Do not submit passwords, payment-card details, health records, or other sensitive information that is unnecessary for the requested task.
You are responsible for any notices, consents, identification, and unsubscribe mechanisms required for communications you initiate. Credits and technical access do not grant permission to contact a recipient.
4. Automation, AI, and external actions
The Service can make network requests, browse websites, generate website descriptions, send emails, and submit contact forms. When you or an authorized client requests an external action, you authorize us to perform it using the information provided. Review the destination, message, sender details, and permissions before making the request. A submitted form or sent email may not be retractable.
AI-assisted results can be incomplete, inaccurate, or inappropriate. Website content and third-party systems can change or interfere with automation. You are responsible for reviewing results before relying on them. We do not guarantee that a message will be delivered, read, or answered, that a form will be accepted, or that a website description is accurate. Do not rely on the Service for emergency or safety-critical decisions.
5. Your content and our Service
You retain your rights in content you submit. You grant us permission to host, process, reproduce, transmit, and display that content as needed to provide the requested Service, maintain activity history, secure the Service, and comply with law, as described in the Privacy Policy. You represent that you have the rights needed to grant that permission.
Ascenso Labs LLC and its licensors retain their rights in the Service, software, branding, and documentation. Subject to these Terms, we permit you to use the Service and its documented interfaces. Third-party content remains subject to its owners' rights; receiving it through PinglyMCP does not transfer those rights to you. AI-generated output may not be unique or eligible for intellectual property protection.
6. Credits, pricing, and availability
Service calls may consume credits and are subject to the allowances, costs, and limits shown in the dashboard, pricing page, and documentation. A completed external action can consume credits even if its recipient does not respond or its result does not meet your expectations. Credits measure Service usage, are not currency, and cannot be transferred or redeemed for cash except where required by law.
A displayed plan does not mean it is available for purchase. If we offer paid plans or credit purchases, the applicable price, payment terms, and any renewal or cancellation conditions will be presented before purchase. Nothing in these Terms limits refund or cancellation rights provided by applicable law.
We may update features, supported tools, prices, and usage limits. Changes to paid commitments will follow the terms presented at purchase and applicable law. We may interrupt access for maintenance, security, capacity, or third-party outages. The Service is not an archival or backup service; keep copies of information you need.
7. Third-party services
Identity providers, AI infrastructure, websites you target, email recipients, and MCP clients have their own terms and privacy practices. Your use of those services may be governed by separate agreements. We do not control third-party content, availability, or decisions and do not endorse a third party merely because the Service connects to it.
8. Suspension and ending use
You may stop using the Service at any time, revoke your API keys, and contact support to request account closure. We may restrict or suspend access when reasonably necessary to address violations of these Terms, unlawful activity, security risks, abuse, or legal requirements. We may discontinue the Service, subject to any applicable paid commitments and mandatory legal rights.
Ending access does not automatically erase all records. The Privacy Policy describes retention and deletion requests. Provisions that by their nature should continue, including accrued payment obligations, ownership, disclaimers, and liability limits, survive termination.
9. Disclaimers
To the extent permitted by applicable law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, complete security, or the accuracy or suitability of results. These exclusions do not affect warranties or rights that cannot legally be excluded.
10. Limits on liability
To the extent permitted by applicable law, Ascenso Labs LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data arising from the Service or these Terms. Our total liability for claims arising from the Service or these Terms will not exceed the greater of US $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
These limits do not exclude liability for fraud, willful misconduct, gross negligence, or any liability that cannot be limited under applicable law. Mandatory consumer protections remain in effect.
11. Changes and general terms
We may revise these Terms and will update the date on this page. For material changes, we will provide notice through the Service or another appropriate channel before the changes take effect, except where an immediate change is required for legal or security reasons. We will seek renewed acceptance where required by law. If you disagree with revised Terms, stop using the Service.
These Terms and any additional terms you expressly accept for an offering form the agreement for that offering. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver of the right to enforce it later.
12. Contact
For questions about these Terms, account closure, or a concern about the Service, contact Ascenso Labs LLC, the operator of PinglyMCP, at support@pinglymcp.com.
